The aim of this document is to regulate the General Terms and Conditions for using the online booking services of Promotora Kasde S.A., a Spanish company with registered address at C/Castellnou 61, 08017 Barcelona, with telephone number 932360000, tax identification number A-08405490 and which is registered on the Companies Registry of Barcelona, in volume 2765, section 2, folio 229, sheet number 29428, 1st entry.
The terms "you" and "user" are used her to refer to all those individuals who for any reason whatsoever access www.cataloniarivieramaya.com (hereinafter, the website) or who use the services provided on the portal. The use of these services shall imply the full and unreserved acceptance and validity of all of the General Terms and Conditions. As a customer, you hereby state that you are of age and have sufficient legal capacity to be bound by these General Terms and Conditions when you contract services from Hoteles Catalonia.
Hoteles Catalonia hereby informs you that the procedures for obtaining the services offered are those described herein, in addition to any specific terms and conditions displayed on screen while you are browsing, so that you are able to state that you are aware and accept such procedures as a requisite to contracting the services offered on the website.
2 Use of online booking services
The online booking services are intended to be used for booking rooms at any of Hoteles Catalonia's hotels. The use of these services shall imply the full and unreserved acceptance and validity of all of the General Terms and Conditions set out in the latest updated version. When the user uses this service, she/he shall receive a confirmation email with a booking reference number. This email shall serve as proof of your booking and confirmation of its acceptance.
Bookings made through this website shall be covered by warranty through the credit card provided by the user on the form. Failure to check in or cancellations made outside the deadline (less than 24 hours) shall be automatically debited from the credit card used in the amount charged for one night, plus cancellation fees. To cancel a booking, you can call our booking call centre on 902301078 from Mondays to Fridays from 8:30 a.m. to 8 p.m., and on Saturdays and Sundays from 10 a.m. to 2 p.m. and 4 p.m. to 8 p.m. Please call your hotel destination directly outside of our office hours.
The prices are per room and per night. Information about VAT, other indirect taxes and the tourist tax are given with each booking.
The user undertakes to use the services in compliance with law and order, moral standards and proper conduct, in addition to with the provisions in these General Terms and Conditions. Therefore, you undertake not to use the services for unlawful purposes and/or in breach of the provisions set out herein, or that are harmful to the rights and/or interests of third parties, or that could cause damage to the services and/or image of Hoteles Catalonia in any way whatsoever. For the greater convenience and benefit of users, Hoteles Catalonia may, at any time and without prior warning, unilaterally modify the services provided or the operating and technical terms and conditions of use of the services.
3 Personal data protection
Pursuant to the provisions of Act 15/1999, of 13 December, on personal data protection, all of our hotels, a list and all other details of which are available at the link www.cataloniarivieramaya.com (hereinafter, HOTELES CATALONIA), guarantee that all personal data provided by guests and users through this website shall be kept in the strictest confidentiality. HOTELES CATALONIA processes such data for the purposes of handling, managing and attracting requests for the products and services offered by its hotels at www.cataloniarivieramaya.com, as well as for sending marketing messages, should the user have so requested or have taken out one of our services and has not refused to receive such messages. To do so, it shall store all information received in databases, which have been duly declared and registered with the General Registry of the Data Protection Agency. Furthermore, your data shall be used to provide you with a better service in all of our hotels and to inform you using any medium, including email and text message, of the services, leisure promotions and trips offered by our own or partner establishments, whether directly or through our loyalty club Wanup, for which your data (unless you state otherwise) may be transferred to Wealth, S.A. (Wanup).
Our guests' details are processed in accordance with the abovementioned regulations, and are considered to be up to date and valid unless we are notified otherwise. We would therefore request that you inform us of any changes in your personal details. (Hoteles Catalonia) or Wealth S.A. (Wanup) at their registered offices at C/Castellnou, 61, Barcelona 08017.
4 Intellectual and industrial property
The website and its contents, including the designs, texts, graphic displays, logos, icons, buttons, as well as the software, trade names, brands, works, illustrations, photographs and technical drawings or any other marks that could potentially be used for industrial or business purposes (i) are held and owned by Promotora Kasde S.A. or third-party owners who have given their due consent for them to be posted on the website (ii) and are protected by domestic and international laws on intellectual and industrial property.
Under no circumstances may it be understood that Promotora Kasde S.A. has granted any licence whatsoever or that is has waived, assigned or transferred any of these rights, either in full or in part, nor that it has granted or will grant in the future any rights, specifically, the right to alter, transform, exploit, reproduce, distribute or publicly disclose said contents with the prior express consent in writing of Promotora Kasde S.A. or the corresponding owners. 5 Modifications to the General Terms and Conditions
Hoteles Catalonia reserves the right to unilaterally modify any of the points provided for herein without prior warning in the manner it deems fit.
6 Severability of the General Terms and Conditions
Should any of the clauses in these terms and conditions be declared void or unenforceable, the rest of the general terms and conditions shall remain as set forth herein. None of the clauses in this agreement shall in any way affect the inalienable rights of consumers. If you are not a consumer, you expressly waive your right to withdrawal.
7 www.cataloniarivieramaya.com and acceptance of the rules of use
The user is aware that the use of the online booking services implies the full and unreserved acceptance of all of the clauses that make up the rules of use of the website in the version posted by Hoteles Catalonia at the time the user contracts a service. Said rules of use supplement these General Terms and Conditions in all matters that do not contradict the latter. Therefore, the user must be aware of the importance of reviewing the rules of this web page before accessing and/or using these services.

Theses General Terms and Conditions are subject to Spanish law and any disputes that may arise from them shall be resolved before the Courts and tribunals of the city of Barcelona, Spain, which shall have sole and exclusive powers over any other jurisdiction whatsoever. The foregoing shall be without prejudice to the powers of the Courts and Tribunals of the domicile of consumers should they have consumer and user status as provided for in Act 1/2007, which passed the amended text of the Consumer Protection Act, as well as any other additional laws or regulations in force that may substitute it at any given time.
